CLIENT TERMS & CONDITIONS

These Client Terms & Conditions (“Terms”) apply to the professional services provided by Heather Banszky / Banszky Therapies, a division of The Banszky Group (“Heather Banszky,” “the Practitioner,” “we,” “us,” or “our”).

Please read these Terms carefully before booking or participating in any session.

By booking an appointment, submitting payment, or participating in a session, you acknowledge that you have read, understood, and agreed to these Terms.

If you do not agree to these Terms, you should not book or participate in a session.

1. FREE INITIAL CONSULTATION

Where offered, you may be provided with a complimentary 15–30 minute online initial consultation.

The purpose of the consultation is to discuss your concerns, objectives, and circumstances and to determine whether the services offered may be appropriate for you.

No therapy or therapeutic treatment is provided during the initial consultation.

Any discussion regarding the potential number of sessions that may be appropriate is an estimate only and is based on the information available at the time of the consultation. Such estimates are not guarantees and may change as additional information becomes available or as your circumstances and goals develop.

2. BOOKING AND PAYMENT

2.1 Initial Booking Deposit

A non-refundable deposit of $555.00 CAD, plus applicable taxes, is payable at the time of booking your first in-person or online session.

The deposit reserves your appointment time and compensates for time allocated to scheduling, preparation, administration, and professional services associated with the appointment.

The deposit is non-refundable except where a refund is required by applicable law or otherwise expressly agreed to by the Practitioner.

2.2 Subsequent Sessions

Unless otherwise agreed in writing, applicable session fees must be paid in accordance with the payment arrangements communicated to you before booking or before the relevant session.

It is the client's responsibility to ensure that required fees are paid in order to confirm and maintain an appointment.

2.3 Fees

All applicable professional fees will be disclosed or confirmed before booking.

Professional fees may be reviewed and changed from time to time. Any applicable fee will be confirmed before a new appointment is booked.

3. CANCELLATION, RESCHEDULING AND REFUNDS

3.1 Notice Requirements

If you need to cancel or reschedule an appointment, you are asked to provide as much notice as reasonably possible.

Cancellation or rescheduling requests must be communicated by email, telephone, or text message at least 24 hours before the scheduled appointment time.

3.2 Late Cancellation

Cancellations made less than 24 hours before the scheduled appointment may result in forfeiture of the applicable payment or deposit.

No refund will ordinarily be provided for cancellations made within 24 hours of the scheduled appointment, subject to any rights or remedies available under applicable law.

3.3 Missed Appointments

Failure to attend a scheduled appointment without providing the required notice may be treated as a missed appointment.

In such circumstances, the applicable payment or deposit may be forfeited and the Practitioner may require payment of any applicable fee before a future appointment is scheduled.

3.4 Attended Sessions

Professional fees are charged for the time, preparation, professional expertise, and services provided during a session and are not a guarantee of a particular outcome.

Accordingly, fees for sessions that have been attended are generally non-refundable.

3.5 Prepaid Packages or Programs

Where a client has purchased a discounted package or therapy program in advance and subsequently chooses to discontinue before completing all included sessions, any refund will be determined based on the applicable package terms.

Where a pro-rated refund is applicable, the refund may be calculated by deducting the full standard fee for sessions already attended from the amount originally paid.

Any refund remains subject to applicable law and the specific terms communicated to the client at the time of purchase.

4. PAYMENT METHODS

Payment arrangements will be confirmed with the Practitioner in advance.

Depending on the service and arrangement, payment may be made by:

  • electronic funds transfer (e-transfer);

  • credit card; or

  • debit card.

Payment may be required at the time of booking, before the session, or at the conclusion of a session, depending on the agreed payment arrangement.

Cash or cheque payments will not be accepted unless specifically agreed upon in advance.

5. CONTACT BETWEEN SESSIONS

Routine communication between sessions may take place by telephone, text message, and/or email during regular office hours.

Current office hours are:

Tuesday, Wednesday and Thursday: 10:00 a.m. – 10:00 p.m.

Messages received outside of regular office hours will generally be reviewed and responded to during the next available office hours.

Communications between sessions are not intended to provide emergency, crisis, or urgent medical or psychological support.

If you are experiencing an emergency or believe that you or another person is at immediate risk of harm, you should contact the appropriate emergency or crisis service rather than relying on communication with the Practitioner.

6. MEDICAL AND PSYCHOLOGICAL CONDITIONS

The Practitioner may ask questions about your medical, psychological, or treatment history where reasonably necessary to assess whether the services may be appropriate and to identify circumstances that may affect your participation.

You agree to provide accurate and complete information that is reasonably relevant to your participation in therapy and to notify the Practitioner of any significant changes to your medical, psychological, or treatment circumstances during the course of services.

If you are receiving treatment or care from a physician, psychologist, psychiatrist, counsellor, or other healthcare professional, the Practitioner may require you to obtain appropriate professional advice or written clearance before commencing or continuing sessions.

Where the Practitioner determines that a particular condition, circumstance, or presentation falls outside the Practitioner’s scope of practice or presents a safety concern, the Practitioner may decline to provide or may discontinue services.

The Practitioner may specifically decline to provide hypnotherapy or related services where epilepsy, psychosis, or another condition creates a concern regarding the appropriateness or safety of the service.

Where appropriate, you may be referred to a qualified healthcare professional for assessment or treatment.

7. AGE REQUIREMENTS

Clients participating in online sessions must be at least 18 years of age.

Clients under 18 may only participate in an in-person session, subject to the Practitioner’s acceptance of the appointment and any applicable requirements regarding parental or guardian involvement and consent.

The Practitioner reserves the right to request proof of age where reasonably necessary.

8. ATTENDING YOUR SESSION

Clients are expected to be available and ready to participate at the scheduled start time.

If you anticipate being late, please notify the Practitioner as soon as reasonably possible.

The Practitioner will make reasonable efforts to provide the scheduled session time; however, where a client's late arrival affects the availability of the Practitioner or conflicts with appointments scheduled afterward, the session may need to conclude at the originally scheduled end time.

Late arrival does not automatically entitle the client to an extension, replacement appointment, or refund.

9. HYPNOTHERAPY RECORDINGS

Any hypnotherapy, relaxation, or therapeutic recordings provided to you are intended for your personal use only.

You must not listen to recordings while:

  • driving;

  • operating machinery;

  • cycling or engaging in activities requiring full attention;

  • supervising children or others where your full attention is required; or

  • engaging in any activity where reduced alertness could create a safety risk.

Recordings must not be copied, reproduced, distributed, published, sold, licensed, shared, or provided to another person without prior written permission from the Practitioner.

10. OUTCOMES AND NO GUARANTEE

Participation in therapy does not constitute a guarantee that a particular issue, concern, symptom, behaviour, or goal will be resolved.

Individual responses to hypnotherapy and other therapeutic techniques vary significantly.

The Practitioner makes no guarantee, representation, or warranty regarding a particular therapeutic outcome.

The Practitioner will, however, make reasonable professional efforts to provide services within their scope of practice and to work collaboratively toward the goals identified with the client.

11. CLIENT PARTICIPATION AND RESPONSIBILITIES

The client acknowledges that participation, motivation, communication, and engagement are important components of the therapeutic process.

Clients agree to:

  • participate honestly and to the best of their ability;

  • provide accurate and relevant information;

  • communicate significant changes that may affect their participation;

  • follow reasonable instructions relating to the safe use of therapeutic materials;

  • make reasonable use of therapeutic suggestions and exercises provided between sessions; and

  • communicate any concerns regarding the services to the Practitioner.

The client remains responsible for their own decisions, actions, healthcare choices, and participation in the therapeutic process.

The client may choose to discontinue participation in sessions at any time, subject to the applicable booking, payment, and cancellation terms.

12. STANDARDS OF BEHAVIOUR

The Practitioner is committed to treating clients respectfully, professionally, and with appropriate regard for their dignity, privacy, and wellbeing.

Clients are likewise expected to conduct themselves respectfully and appropriately.

Clients must not engage in threatening, abusive, violent, harassing, discriminatory, or otherwise inappropriate conduct toward the Practitioner, other clients, or any person involved in providing the services.

Clients must not intentionally damage property or place another person at unreasonable risk of harm.

A client must not attend a session while impaired by alcohol or recreational drugs.

Where the Practitioner reasonably believes that a client is impaired, threatening, abusive, violent, or otherwise unable to participate safely, the Practitioner may terminate or refuse the session and may decline to provide further services.

In such circumstances, any refund or credit will be determined in accordance with the applicable cancellation and payment terms and applicable law.

13. CONFIDENTIALITY

The Practitioner will take reasonable steps to maintain the confidentiality and privacy of information shared during sessions and communications.

This includes information provided during sessions, telephone conversations, text messages, emails, notes, and other communications relating to the provision of services.

Where a session or communication is proposed to be recorded, the client's agreement will be sought where required.

Confidentiality may be limited or information may be disclosed where:

  1. the client provides consent or authorization;

  2. disclosure is required or authorized by applicable law;

  3. disclosure is required pursuant to a valid court order, subpoena, or other lawful authority;

  4. disclosure is reasonably necessary to address a serious and imminent risk of harm to the client or another person;

  5. disclosure is required or permitted to protect a child or vulnerable person from abuse, neglect, or serious harm; or

  6. another legal or professional obligation requires or permits disclosure.

The Practitioner will make reasonable efforts to limit any disclosure to the information reasonably necessary for the applicable purpose.

Nothing in these Terms overrides rights or obligations imposed by applicable privacy legislation.

14. CONSULTATION WITH OTHER PROFESSIONALS

Where appropriate and with the client's consent, the Practitioner may communicate with another healthcare or professional provider involved in the client's care.

Where a report or information is provided to another professional with the client's authorization, the client may request a copy, subject to applicable law and any applicable professional or legal requirements.

The Practitioner may also consult with professional colleagues for the purpose of professional development, supervision, or case consultation.

Where such consultation occurs, reasonable steps will be taken to protect the client's identity and confidentiality unless disclosure of identifying information is authorized or otherwise legally required.

15. LIABILITY

The Practitioner will provide services with reasonable care and within the Practitioner’s scope of practice.

To the fullest extent permitted by applicable law, the Practitioner will not be responsible for losses or damages arising from matters outside the Practitioner’s reasonable control or from decisions or actions taken independently by the client.

Nothing in these Terms is intended to exclude or limit liability that cannot legally be excluded or limited under applicable law.

The Practitioner does not guarantee any particular therapeutic, medical, psychological, financial, or other outcome from participation in the services.

The client remains responsible for seeking appropriate medical, psychological, psychiatric, or other professional care where required.

16. GOVERNING LAW

These Terms will be governed by and interpreted in accordance with the laws applicable in the Province of Alberta and the applicable laws of Canada.

Any dispute arising in connection with these Terms will be subject to the jurisdiction of the courts having appropriate jurisdiction in Alberta, subject to any mandatory rights or remedies available to the client under applicable law.

17. CHANGES TO THESE TERMS

These Terms may be updated from time to time to reflect changes in services, business practices, applicable legislation, or other relevant circumstances.

The current version will be made available to clients through the Practitioner’s website or other appropriate means.

Where a client recommences therapy following a significant period of absence, the Practitioner may require the client to review and acknowledge the current Terms before commencing further sessions.

18. PRIVACY AND PERSONAL INFORMATION

Personal information collected, used, disclosed, and retained in connection with the services will be handled in accordance with the applicable Privacy Policy and applicable privacy legislation.

The Privacy Policy explains how personal information is collected, used, disclosed, safeguarded, and retained, as well as applicable rights relating to personal information.

By booking and participating in services, the client acknowledges that they have had an opportunity to review the Privacy Policy.

The Privacy Policy may be updated from time to time. Clients are encouraged to review the current version periodically.

19. CONCERNS AND COMPLAINTS

If you have a concern or complaint regarding your experience or the services provided, you are encouraged to raise the matter with Heather Banszky directly in the first instance.

Reasonable efforts will be made to understand and address the concern and, where appropriate, resolve the matter.

Nothing in this section prevents a client from exercising any legal, regulatory, privacy, or other rights available to them under applicable law.

20. CLIENT ACKNOWLEDGEMENT AND STATEMENT OF UNDERSTANDING

By booking or participating in services, the client acknowledges and understands that:

  1. The Practitioner provides services only within the scope of the therapies and services she is qualified and authorized to provide.

  2. Individual results vary and no particular therapeutic outcome is guaranteed.

  3. Hypnotherapy and related services are complementary services and are not a replacement or substitute for medical, psychological, psychiatric, or other professional healthcare treatment or advice.

  4. If the client has concerns regarding their physical or psychological health, they should seek advice from an appropriately qualified healthcare professional.

  5. If the Practitioner advises the client to obtain medical or other professional clearance before commencing or continuing therapy, the client agrees to obtain such advice before proceeding where reasonably required.

  6. The client may choose to discontinue therapy at any time, subject to applicable booking, cancellation, payment, and refund terms.

  7. The client's motivation, participation, honesty, and reasonable engagement with the therapeutic process may affect their experience and results.

  8. The client agrees to provide accurate and truthful information that is reasonably relevant to the provision of services.

  9. Any therapeutic exercises, recordings, or suggestions provided for use between sessions are intended to support the therapeutic process and should be used in accordance with the Practitioner’s instructions.

  10. The client understands and agrees to comply with the safety, confidentiality, communication, and behavioural requirements contained in these Terms.

21. CLIENT CONFIDENTIALITY ACKNOWLEDGEMENT

The client understands that confidentiality is subject to the limitations described in these Terms and applicable privacy legislation.

The client understands that information may be disclosed without further consent where disclosure is required or authorized by law, including circumstances involving a serious and imminent risk of harm, the protection of a child or vulnerable person, or a valid legal requirement such as a court order or subpoena.

The client also understands that the Practitioner may participate in professional consultation or supervision and, where reasonably possible, will protect the client's identity and confidentiality during such consultation.

22. ACCEPTANCE OF TERMS

By booking an appointment, submitting payment, or participating in a session, the client confirms that they:

  • have read and understood these Client Terms & Conditions;

  • have had an opportunity to ask questions or seek clarification;

  • understand that the services do not guarantee a particular outcome;

  • understand the applicable payment, cancellation, and refund requirements;

  • understand the limitations of confidentiality;

  • understand that the services are not a substitute for medical or mental healthcare; and

  • voluntarily agree to these Terms.

If you do not agree to these Terms, please do not book or participate in a session.
